The DUI Process

Driving under the influence, also known as drunk driving, is aggressively policed in Glendale. DUI checkpoints and increased enforcement are common within the city during weekends and holidays, and the punishment for even a first DUI conviction is becoming increasingly punitive. The “pink license,” as it is commonly referred to as, not only operates as your temporary license, but your formal notice to contact the DMV within 10 calendar days of your arrest to request an administrative hearing to contest your pending license suspension. If your request is not made within the 10 day period, your license will be suspended automatically after 30 days from your date of arrest. Because the DMV suspension can be imposed independently from your outcome in criminal court, your privilege to drive can be suspended even before a court conviction or in some cases, before you have even appeared in court. However, if your timely hearing request is made, your DMV hearing would be heard at the Van Nuys Driver Safety Office located at 6150 Van Nuys Blvd. in the city of Van Nuys.

Your initial appearance in court, otherwise known as an “arraignment hearing,” is the beginning of the criminal aspect of your DUI case. During your arraignment hearing, the judge will inform you of your charges and your rights, and then ask you to enter a plea: Guilty, No Contest, or Not Guilty. A plea of guilty or no contest will effectively end your case. However, a not guilty plea will transition your case to the next phase in the criminal court process - the pretrial phase. During the pretrial phase, your DUI attorney can file motions and investigate the prosecution’s evidence against you, such as issuing subpoenas for radio/communication logs, dash/body cam footage, audio evidence, maintenance records of the breath instrument, blood split sample for independent lab retesting. Plea bargains with prosecutors are negotiated during the pretrial stage. If a pretrial plea agreement cannot be reached, your case will proceed to a trial.
